These Terms and Conditions (“Terms”) govern your use of our websites at www.Blueweelz.com, www.BlueWeelz.com/driver, and our iOS and Android mobile applications (collectively, our “Platform”). By accessing or using the Platform, you agree to comply with and be bound by these Terms. Please read them carefully.

  1. Eligibility

To use the Blueweelz rider/passenger app, you must be at least 18 years of age. By using the Platform, you represent and warrant that you meet this age requirement.

  1. Services

Blueweelz is a platform that connects users requiring wheelchair-accessible rides with partner drivers who operate ADA-approved vehicles. The Platform provides a marketplace for users to request and receive transportation services from independent contractors.

  1. Account Registration

To use the Platform, you must register and create an account. You agree to provide accurate and complete information during the registration process and to update this information as necessary to keep it accurate and complete. You are responsible for maintaining the confidentiality of your account login information and are fully responsible for all activities that occur under your account.

  1. Payment and Fees

Payment for rides is securely processed by Stripe, our third-party payment provider. You agree to pay the applicable fees for the services you request through the Platform. All payments are final and non-refundable unless otherwise determined by Blueweelz.

  1. Cancellation and No-Show Policy

To ensure the smooth operation of our platform, Blueweelz has established the following cancellation and no-show policies:

  1. Driver Cancellation and No-Show Fee:
  1. Driver Wait Time: If a driver arrives at the designated pick-up location specified by the rider and waits for 15 minutes without the rider arriving or being ready for pick-up, the driver has the right to cancel the ride request.
  2. No-Show Fee: In the event of a cancellation by the driver due to the rider’s failure to arrive within the 15-minute wait time, a no-show fee of $15 will be charged to the rider’s account.
  1. Rider Cancellation:
  1. Cancellation Before Driver Arrival: A rider may cancel a ride request at any time before the driver arrives at the designated pick-up location. If the rider cancels before the driver’s arrival, no fee will be charged.
  2. Cancellation After Driver Arrival: If the rider cancels the ride request after the driver has arrived at the pick-up location and the driver has waited less than 15 minutes, a cancellation fee of $10 will be charged to the rider’s account.
  1. Driver Reassignment:
  1. Driver Unavailability: If the initially matched driver is unable to fulfill the ride request after accepting it, Blueweelz will automatically search for another available driver to complete the request.
  2. No Additional Fees: No additional fees will be charged to the rider for the reassignment of a new driver in the event of driver unavailability.
  1. Wait Time During Stops:
  1. Charges for Wait Time: If a rider adds a stop to their ride, the driver may wait for the rider at the stop. Wait time during stops will be charged to the trip at the applicable rate. The rider agrees that such charges will be added to the total fare for the trip.

By using the Blueweelz platform, you agree to these cancellation, no-show, and wait time policies and acknowledge that any fees incurred will be automatically charged to your payment method on file.

  1. User Conduct

You agree to use the Platform only for lawful purposes and not to engage in any behavior that is harmful, disruptive, or otherwise inappropriate, including but not limited to:

  • Violating any local, state, or federal laws or regulations.
  • Using the Platform to commit fraud or other illegal activities.
  • Interfering with or disrupting the integrity or performance of the Platform.

Violations of these policies may result in the suspension or termination of your account.

  1. Termination

Blueweelz reserves the right to suspend or terminate your account and access to the Platform at any time, without notice, if you violate these Terms or engage in conduct that Blueweelz determines to be inappropriate or harmful.

  1. Limitation of Liability

To the fullest extent permitted by applicable law, Blueweelz LLC, its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising out of or related to your use of the Platform, whether based in contract, tort (including negligence), strict liability, or otherwise, even if Blueweelz has been advised of the possibility of such damages.

This limitation of liability does not apply to the extent that such damages arise from Blueweelz’s gross negligence, willful misconduct, or any other conduct for which liability cannot be excluded or limited under applicable law.

Blueweelz maintains insurance coverage for its drivers during the provision of rides arranged through the Platform. This coverage is intended to address certain liabilities that may arise during a ride. The limitation of liability stated herein is intended to supplement, not replace, the protections offered by such insurance. However, in no event shall Blueweelz’s liability exceed the amount covered by applicable insurance or, if no insurance coverage applies, the amount paid by you for the specific ride from which the claim arose.

By using the Platform, you acknowledge and agree that this limitation of liability is reasonable and reflects a fair allocation of risk between you and Blueweelz, given the nature of the services provided.
